CASUAL OVERTIME CASE BACKPAY
In late 2021, the VAU began a significant body of work to ensure that casual members were being paid overtime entitlements correctly.
This ultimately ended in the Federal Court in late 2023, where the VAU successfully argued that casual employees had been incorrectly paid their overtime payments. AV agreed to correct the underpayment in line with the VAU’s interpretation of the overtime clause. This means overtime rates are applied to the casual employee’s normal rate of pay inclusive of casual loading, for any hours worked in addition to shift times (incidental OT).
AV corrected the overtime payment for current employees and committed to auditing underpaid overtime entitlements over the proceeding six months.
While AV’s audit has been subject to significant delay, along with other payroll delays, the VAU has been advised that the back payment, plus interest, will be processed in the upcoming AV pay run.
The amount retrieved for casual members totals over $788,000 and would not have been paid if the VAU had not brought this matter to court.
This is an excellent but long overdue outcome and members who were party to this underpayment case are to be congratulated for their efforts.
